DATA WE MAY COLLECT We collect Personal Data from you in the following ways: Personal Data which you voluntarily provide to us. For example, you may provide your Personal Data or Personal Data of other individual(s) to us when you: complete a user profile or registration forms (such as your name, contact information, bank account name, bank account number along with other identification information, where needed); provide information to assess your eligibility to provide services as a Provider, which may include data indicating the validity of your vehicle, a copy of your driver’s license and your vehicle log cards; mobile device information, such as operating system version, device type, and system performance data; data collected via tracking technologies, as fully described below in this section. We may also combine the collected Personal Data of an individual with other Personal Data of that individual that is in our possession. If you have or are a party to multiple relationships with us (for example, if you are both a User and a Provider (as defined in our Terms of Use)), we may link any Personal Data collected from you across your various capacities to facilitate your use of our Service and for the purposes described below in section 3. All the information required in the open text fields during the account registration process is mandatory. Any failure to complete that information or any response BinaryDev considers abnormal may result in BinaryDev refusing (or being unable) to process your request. You agree that any Personal Data you provide about yourself or on an individual’s behalf to BinaryDev is current, accurate, complete, and unequivocal. Sensitive Personal Data Some of the Personal Data that we collect may be sensitive in nature. This includes: any identification numbers or passport numbers of the director(s) and shareholder(s) of the Company’s ACRA Business Profile; or bank account number(s). We collect this information only with your consent and/or in strict compliance with applicable laws and regulations, including Indonesian laws. Derivative Data Information our servers automatically collect when you access the Applications, such as your native actions that are integral to the Applications, including creating jobs, accepting jobs, completing jobs, as well as other interactions with the Applications and other Users and/or Providers via server log files. Financial Data Financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date, billing address, and the last four digits of your card number) that we may collect when you purchase, order, return, exchange, or request information about our services from the Applications. We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor, which may include but is not limited to PayNow, Paypal, and/or Stripe, and you are encouraged to review their respective data/privacy policies and contact them directly for responses to your questions. Geo-Location Information We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the Applications to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings, but we strongly encourage you not to do so as we usually only send important notifications that are crucial to your smooth usage of the Applications. Mobile Device Access We may request access or permission to certain features from your mobile device, including your mobile device’s Bluetooth; camera; contacts; microphone; sensors; short message service (“SMS”) messages; storage; and other relevant features required for you to use the Applications. If you wish to change our access to these features, you may do so in your device’s settings, but we strongly encourage you not to do so as we usually only send important notifications that are crucial to your smooth usage of the Applications. Push Notifications We may request to send you push notifications regarding your account or the Applications. Tracking Technologies BinaryDev uses technologies such as cookies, web beacons, tags, and scripts to enable a service to recognize your device when you access the Website and/or Applications. This allows you to avoid having to provide the same data several times during one task. We may use local storage, such as HTML5, to store content data and your preferences. Third parties with whom we partner to provide certain features on the Products also use HTML5 to collect and store data. Various browsers may offer their own management tools for removing HTML5. Third-Party Data Information from third parties, such as personal information, if you connect your account to the third party and grant the App permission to access this information. From time to time, we may also partner with third parties, such as Facebook and Google, to manage our advertising of the Applications and/or Service on other sites or platforms as well as across your other devices based on your past visits to our Website. Our third-party partners may use technologies such as cookies to gather data about your activities within the Products to deliver such advertising to you, such as retargeting ads. We are not always able to respond to do-not-track signals. You may opt-out of receiving ads across devices by adjusting your ad preferences in your Google account. HOW WE USE COLLECTED PERSONAL DATA BinaryDev may collect and use the Personal Data for the following purposes: to improve customer service; increase the efficiency and operation of the Applications; compile anonymous statistical data and analysis for use internally or with third parties; monitor and analyze usage and trends to improve your experience with the Applications; notify you of updates to the Applications; offer new products, services, mobile applications, and/or recommendations to you; perform other business activities as needed; prevent fraudulent transactions, monitor against theft, and protect against criminal activity; process payments and refunds; request feedback and contact you about your use of the Applications; resolve disputes and troubleshoot problems; respond to product and customer service requests; and/or solicit support for the Applications through the usage of anonymized User/Provider data for fund-raising and marketing purposes. Newsletters or other Electronic Communications If you sign up to receive promotional materials from us via email and/or push notifications, we will use your Personal Data to provide the communications you have requested. If you inform us that you wish to cancel email promotional materials by selecting “unsubscribe” at the bottom of such communication or by emailing us at hello@binarydev.co.id, we will remove you from our mailing list within 14 business days from the date of making such a request. If you no longer wish to receive push notifications, you may turn them off at the device level. If you provide your phone number to us directly or through a third party for the specific purpose of receiving an SMS message with a link to our Website and/or Applications, you will receive such an SMS message. Standard SMS message rates will apply. HOW WE PROTECT YOUR PERSONAL DATA The security of your Personal Data is important to us. We adopt appropriate data collection, storage, and processing practices and reasonable security measures to protect against unauthorized access, alteration, disclosure, or destruction of the Personal Data stored on our database. However, while no method of electronic storage is fully secure, BinaryDev strives to protect the security of the Personal Data in our possession, and we are constantly reviewing and enhancing our security measures in place. DISCLOSURE OF YOUR PERSONAL DATA We do not sell or trade the Personal Data in our possession to other parties. We may share generic aggregated demographic information not linked to any personal identification information regarding Users, Providers, and/or any other individuals with our business partners, trusted affiliates, and advertisers for the purposes outlined above in section 3. We may use third-party service providers to help us operate our business and the App or administer activities on our behalf, such as sending out newsletters or surveys. We may share your Personal Data with these third parties for those limited purposes provided that you have given us your permission. TRANSFER OF PERSONAL DATA OUTSIDE OF INDONESIA Your Personal Data may be transferred to, stored, or processed in a country other than the country in which it was collected, including, but not limited to, the United States, the United Kingdom, the European Union, and other countries where our servers or our third-party service providers are located. By using our Service or providing us with any Personal Data, you agree to the transfer of your Personal Data to, and processing of such data in, other countries. RETENTION OF PERSONAL DATA We will retain your Personal Data for as long as it is necessary to fulfill the purpose for which it was collected, the legal or business purposes of BinaryDev, and/or as may be required by applicable law.
